A resolution of the council of the village of Forest, Ohio authorizing the Forest police department to perform safety inspections of golf carts and other under speed vehicles for the purpose of making them street legal through the Ohio BMV, charging an appropriate fee, and declaring an emergency.
WHEREAS, the Village of Forest, Hardin County, Ohio Police department has historically performed safety inspections of golf carts, side by side ATVs, and other “under speed vehicles” for the purpose of getting registrations from the Bureau of Motor Vehicles to make said vehicles street legal on designated roadways; and
WHEREAS, the Village of Forest, Hardin County, Ohio Police Department, being one of the
only two agencies in Hardin County to perform such inspections, spends a substantial amount of
time on these inspections during certain times of year, and;
WHEREAS, the Village of Forest, Hardin County, Ohio Police Department wants to recoup some of its expenses related to said safety inspections.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Forest, Hardin County, Ohio:
Section 1: That the Village of Forest, Hardin County, Ohio Police Department shall continue to perform safety inspections of Golf carts and other under speed vehicles as time allows.
Section 2: The Village of Forest, Hardin County, Ohio Police Department shall charge residents living in the Forest, Ohio zip code $25.00 for these inspections.
Section 3: The Village of Forest, Hardin County, Ohio Police Department shall charge all others seeking safety inspections $50.00 for these inspections.
Section 4: The fees collected for the inspections herein shall be deposited in the Village of Forest, Ohio’s General Fund, to be utilized as the Village Council finds appropriate.
Section 5: This Resolution shall be an emergency measure for the immediate and best protection of the public peace, health, safety, and welfare, the particular emergency being the need to address safety, and health issues in the Village of Forest in a timely manner. Therefore, if passed by the requisite two-thirds of all members elected to Council, this Ordinance shall be in force and effect from and after its approval by the Mayor; otheiwise, from and after the earliest period
allowed by law.
